1. Introduction
These Terms and Conditions (“Terms”) govern your access to and use of the website neonperso.com (the “Site”) and the purchase of any products from it. The Site is operated by AK Sales Solutions Ltd, a company registered in England and Wales under company number 15885829, whose registered office is at 9 Cringle Drive, Cheadle, England, SK8 1JH (“we”, “us”, “our”), trading as Neon Perso – Custom LED Neon Signs.
By accessing the Site or placing an order, you confirm that you have read, understood and agree to be bound by these Terms. If you do not agree, please do not use the Site.
2. Definitions
- “Customer”, “you”, “your” means the person accessing the Site or placing an order.
- “Goods” means the products, including custom and personalised LED neon signs, offered for sale on the Site.
- “Custom Goods” means any Goods made, configured or personalised to your specification (for example bespoke text, colours, sizes or designs).
- “Order” means your order for Goods submitted through the Site.
3. Eligibility and Use of the Site
You must be at least 18 years old, or have the consent of a parent or guardian, to place an order. You agree to use the Site only for lawful purposes and not to misuse it, interfere with its operation, or attempt to gain unauthorised access to it.
4. Products and Custom Orders
We take care to display our Goods accurately; however, colours, brightness and sizes shown on screen may vary slightly from the finished product due to differences in displays and the handmade nature of our Goods.
For Custom Goods, you are responsible for ensuring that all details you provide (including spelling, text, dimensions, colours and artwork) are correct before approving your order or design proof. Where we provide a design proof for approval, production will begin only after you approve it, and we are not liable for errors contained in approved details.
Minor variations in size, colour and finish are inherent to handmade neon products and do not constitute a defect.
5. Pricing and Payment
All prices are shown in pounds sterling (GBP) and, where applicable, are inclusive of VAT. Delivery charges are shown separately at checkout. We reserve the right to change prices at any time, but changes will not affect Orders we have already accepted.
Payment must be made in full at the time of ordering through the payment methods offered on the Site. By submitting payment details you confirm that you are authorised to use the payment method.
6. Order Acceptance and Cancellation
Your Order constitutes an offer to purchase Goods. A contract is formed only when we send you an order confirmation or dispatch the Goods, whichever is earlier. We may decline or cancel an Order (for example if Goods are unavailable, there is a pricing error, or we are unable to fulfil your specification) and will refund any payment taken for that Order.
7. Shipping and Delivery
We will deliver the Goods to the address you provide at checkout. Estimated production and delivery times are indicative only and not guaranteed. Risk in the Goods passes to you on delivery. Please inspect your Goods on arrival and report any damage promptly (see section 8).
8. Returns, Refunds and Cancellation Rights
Custom and personalised Goods. Because our Custom Goods are made to your specification or clearly personalised, the standard 14-day right to cancel under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 does not apply to them. Custom Goods therefore cannot be returned or refunded simply because you have changed your mind.
Faulty or damaged Goods. Nothing in these Terms affects your statutory rights under the Consumer Rights Act 2015. If your Goods arrive faulty, damaged or not as described, please contact us at info@neonperso.com within 48 hours of delivery, including your order number and photographs of the issue. Where Goods are confirmed to be faulty or damaged, we will, at our discretion, repair, replace or refund the affected Goods.
Non-custom Goods. For any standard (non-personalised) Goods, you may have the right to cancel within 14 days of receipt; such Goods must be returned unused and in their original condition, and return postage may be your responsibility unless the Goods are faulty.
9. Warranty and Product Care
Our LED neon Goods are intended for indoor use unless expressly stated as suitable for outdoor use. We provide a limited warranty against manufacturing defects in the LED components for the period stated on the relevant product page or order confirmation. This warranty does not cover damage caused by misuse, accidental damage, improper installation, unauthorised repair, or normal wear and tear.
10. Intellectual Property
All content on the Site, including text, graphics, logos, images and designs, is owned by or licensed to AK Sales Solutions Ltd and is protected by intellectual property laws. You may not reproduce or use it without our written permission.
Where you supply artwork, text or designs for Custom Goods, you confirm that you own or have permission to use those materials and that they do not infringe any third party’s rights. You grant us a licence to use such materials solely to fulfil your Order. We reserve the right to refuse any Order for content that is unlawful, offensive or infringing.
11. Limitation of Liability
Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud, or for any liability that cannot lawfully be excluded. Subject to that, our total liability to you in connection with an Order shall not exceed the price paid for the Goods, and we shall not be liable for any indirect or consequential loss.
12. Privacy
We process personal data in accordance with our Privacy Policy and applicable data protection law, including the UK GDPR. Please refer to our Privacy Policy for details of how we collect and use your information.
13. Governing Law and Jurisdiction
These Terms and any dispute arising out of or in connection with them are governed by the laws of England and Wales, and the courts of England and Wales shall have exclusive jurisdiction.
14. Changes to These Terms
We may update these Terms from time to time. The version published on the Site at the time you place an Order will apply to that Order.
